The writing assignment explores the area of legal omissions, with reference to the case of Kitty Genovese/Winston Mosely.  It is a 3 page reaction paper as outlined in the Criminal Law Syllabus.   This case was discussed in class.


 


When writing your paper, take into consideration the following:


 


“Omissions -- Did the bystanders owe Kitty Genovese a legal duty?


                        Did the residents have a legal duty to intervene?


                        Should the “neighborly” relationship give rise to a duty?


                         Should a statute impose a duty of individuals to intervene?


 


  Additionally, two short-films were shown in class entitled:  The Modern Bystander Effect and Kitty Genovese and the Bystander Effect as well as the trial testimony and a Daily News article is available on Blackboard. These films and documents should assist you in preparing your reaction paper. Based on the class discussion, films and articles each student should be able to analyze the issues of legal omissions as it relates to the legal theories of the American Bystander Rule/Bystander Effect and the Good Samaritan Doctrine.


 


Your assignment must include:


 


1.      An introductory paragraph – this should state the assignment and introduce the reader to your topic and explain what you are going to discuss.


 


2.      A body – The body should explain your argument, examples, other information including an analysis of the relationship between your legal theories and the position you have discussed in your paper (elaborate on your argument and provide supporting materials).


 


The first sentence of your paragraph should summarize your paragraph by introducing its main idea.  Make it clear and concise.


 


Develop and support the topic sentence with details and facts.  Generally, this can be


done in four or five sentences, but it can be longer as long as you stick to the main topic.


 


 


3.      Conclusion - this should restate the main ideas without using the same words.  Don’t


 repeat your topic sentence.  Conclude as neatly as you started. 


 


 


 


4.      Edit your paper.  Check spelling, grammar, and verb tenses. USE SPELL CHECK AND GRAMMAR CHECK.  Double-check the relevance of any details.

Ø  Double-spaced


Ø  Number your pages


Ø  No wide margins or triple spacing between paragraphs


Ø  Do not copy word for word from the book
